If you are active on the Methnani website or contact our organisation, you sometimes share personal data with Methnani. Methnani handles this data carefully and Methnani complies with the applicable legislation and regulations. These laws deal with the storage and use of your personal data.
In this privacy statement, we will explain which data of yours Methnani collects and what Methnani does with this data. This privacy statement applies to all interactions between you and Methnani, regardless of the manner of communication.
Methnani & Associates B.V. (KvK 53116992), with its registered office at Waarderweg 56, 2031 BP Haarlem, the Netherlands, is the controller for the processing of the personal data as specified in this privacy statement. You can send any questions or comments concerning your privacy to administratie@methnani.nl.
All data that reveals something about you and can be used to identify you is personal data. Examples include your name, your contact and address details and your citizen service number (BSN). Some of this data, such as ethnic background, religion or a criminal record, is special personal data.
Methnani does not collect any special personal data.
It is not the intention of Methnani to process personal data of persons younger than 16 years old. Methnani cannot, however, check whether a visitor to the websites and servers is older than 16 years old. If you think that Methnani has collected personal data from a minor without the consent of a parent or guardian, you can contact us via administratie@methnani.nl and Methnani will delete this information. If data is collected from persons younger than 16 years old by Methnani, this will always happen with the consent of his/her parent or guardian.
Methnani is glad to help you further if you encounter a problem or have a question for Methnani. You can call Methnani, send an email or fill in a form on the website. It may also be the case that Methnani obtains your data via third parties in connection with its service provision. In order to be able to help you further, Methnani saves some of your data. In this way, Methnani knows who you are and Methnani can also retrieve what was previously discussed during the next contact moment. If you purchase services from Methnani, you naturally want to be helped properly and receive what you requested. Methnani saves the following data for the execution of an agreement:
• Name and address details
• Company name
• Job title

The services purchased by you must also, of course, be paid. If you do not do this, Methnani will start a debt collection process. Methnani will save your following data in connection with invoicing & collections:
• Name and address details
• Email address of contact person
• Telephone number of contact person
• Company name
• Chamber of Commerce number
• VAT number (compulsory for foreign clients)
• Language preference (English/Dutch)
• Bookkeeping contact details (Telephone number and email address)

When Methnani makes changes to its services, general terms and conditions, privacy statement or other important matters, Methnani wants to inform you of this. If you agree to this, Methnani will use the following data in order to process your details in the newsletter system:
• Name
• Email address

If you have indicated to Methnani that you would like to receive the newsletter and the freebie, Methnani will save your following data:
• Name
• Email address

If you have sent Methnani a review, Methnani will publish this on the website and/or social media channels. If you agree to this, Methnani will save your following data:
• Name
• Company name (optional)

During the interview process Methnani collects and processes data for an assessment of suitability for the job opening at Methnani, or for an assignment with a client via Methnani. From a website visitor (applicant/candidate/freelancer) who uses our website to apply for a position Methnani stores the following data:
• First name
• Family name
• Phone number
• Resume / CV
• Cover letter
This personal data shall be supplied in case of legitimate interest, legal obligation and/or to enact the terms of the contract by mutual agreement.
Legal basis: legitimate interest, statutory obligation and/or execution of the agreement.
Methnani collaborates with various suppliers and partners for the execution of services. These suppliers & partners include parties that:
• Send newsletters ([to be completed: which tool, e.g. Mailblue/MailChimp?])
• Send post
• Handle payments, collections and bookkeeping (Exact, CROP)
• Support temporary staffing and candidate administration (Lift)
• Provide web hosting ([to be completed: which ICT/hosting provider for Methnani?])
Methnani has entered into processing agreements and/or non-disclosure agreements with subprocessors in order to guarantee the safety of your data. Methnani only collaborates with partners who are able to comply with the GDPR legislation.
A few of the partners are located outside the European Economic Area (the countries within the European Union, Liechtenstein, Norway and Iceland). Your data may be processed in America and/or other countries where these companies have their cloud storage and servers and/or backups. Methnani has taken appropriate measures with these partners which have been contractually agreed via a processing agreement / Data Processing Addendum. For transfers to the United States, Methnani relies on the partner's certification under the EU-US Data Privacy Framework, or, where a partner is not certified, on the European Commission's Standard Contractual Clauses together with any additional safeguards required. In this way, Methnani ensures that your data is properly protected.
In principle, Methnani does not share your data with, or sell your data to, persons or organisations outside Methnani, except partners as specified above. It may also be the case that Methnani is required to pass on your data on the basis of a statutory duty.
Methnani has taken appropriate technical and organisational security measures in order to protect your data against misuse, unlawful or unauthorised use and loss.
All parties that process your data for Methnani (subprocessors) or are able to inspect your data (such as employees or temporary workers) sign a processing agreement or non-disclosure agreement.
Methnani applies different retention periods for different data flows. Of course, you are always entitled to ask Methnani to delete your data. See also the heading 'Your rights' for this.
Methnani will delete your name, address details, telephone number and email 1 year after our last contact.
Emails from more than 1 year ago will be deleted unless they are still relevant for the execution of an agreement or resolving a dispute.
Invoices and quotes will be deleted after the statutory retention period of 7 years. Your data will remain in the invoicing system until that time.
You can delete your data from our newsletter system at any desired moment.
You are entitled to inspect, correct and delete your personal data. In addition, you are entitled to withdraw your consent for the data processing or to lodge an objection against the processing of your personal data by Methnani. You are also entitled to data portability. You can send a request for inspection, correction, deletion or data portability of your personal data, or a request for withdrawal of your consent, or an objection against the processing of your personal data, to administratie@methnani.nl.
In order to be certain that the request for inspection was made by you, Methnani asks you to include a copy of your identity document with the request. Please black out your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and citizen service number (BSN) in this copy.
This is to protect your privacy. If you have a request concerning a cookie, Methnani requests that you also send this. Methnani will respond to your request as soon as possible, but no later than within four weeks. Methnani would also like to point out to you that you have the option of submitting a complaint with the national supervisory authority, the Dutch Data Protection Authority.
If a data breach takes place in spite of all the precautionary measures, Methnani will comply with the data breach notification obligation, and Methnani will report this breach, should this be necessary, to the Dutch Data Protection Authority within 72 hours after discovery thereof. If you discover a data breach, Methnani kindly requests that you share this with Methnani as soon as possible, but in any case within 24 hours after you have discovered the breach, by sending an email to administratie@methnani.nl. Methnani can then take immediate action.
This privacy statement only relates to the personal data that Methnani processes for the benefit of the points discussed in this agreement. Methnani does not accept any responsibility or liability for (the operation and/or content of) websites or services of third parties.
The content of this privacy statement may be amended by Methnani at any time in order to respond to new developments in the areas of legislation and regulations, or changes within the company. You can subscribe to the newsletter in which Methnani will keep you informed of any changes.
In any case, Methnani recommends that you consult our privacy statement on a regular basis in order to keep up to date with our privacy policy. By continuing to make use of the services of Methnani following amendments you agree to these amendments.
